Q: Speeding ticket in Nassau County, NY

Hello! I've just received a speeding ticket in Nassau County, NY and had questions about the process of pleading not guilty. I was given a date on the ticket to mail in not guilty, or show up in person to plead not guilty.

I have the following questions:

1. I don't want to mail in not guilty. Can I show up before the date given and plead not guilty in person? Or do I have to plead not guilty exactly on the date and time given.

2. If i plead not guilty in person, do I immediately get the date for the pretrial, or is it still going to be mailed?

3. I wish to delay the court date as much as I can, possibly 18 months as I believe the points will go away from my record after 18 months (since the 18 months timeframe for the points starts the second you get the ticket). This being the case, once I get my pre-trial date would I be able to reschedule that as much as I can, and then when I can no longer delay, get the actual court date after the pretrial and delay that as well?

A: I'm not sure why you want to plead not guilty in person rather than by mail .

You can go before the date on the ticket and drop off the ticket with a not guilty plea. The date on the ticket is the date by which you must appear or respond by mail.

I believe that the pre-trial conference date will be mailed to you. You can probably reschedule the conference date once, but no more than that.

A: 1. You can plead not guilty in advance.

2. I don't know.

3. This is not correct, as follows:

The points affect your record for insurance purposes starting from the date you are convicted, until 4 years later.

For DMV purposes, the points affect your record from the date of violation, regardless of the date of conviction.

Good luck.
