Q: Can defense Attorney get my private health and mental health records without my authorization?
I slipped on wet staircase at a hotel. Suffered spine, neck, fractured right wrist, broken teeth. Trial is in June. I do not have a attorney

if you are complaining of negligence and an injury then clearly your previous health is an issue to prove that the complaints were not preexisting.

A: they can get the records through discovery voluntarily or through a subpeona. Have you tried to get an attorney to help you? Trials are full of procedural landmines that can derail your case - even if it's a good case. You should get legal help right away.

A: Health records, yes. Mental health records probably not. However, you may need to file a Motion to Quash a subpoena and/or for a protective order. Why would you try to represent yourself?
