Q: My wife and I seperated 3 months ago and she has become terminally ill. Can her sister become my boy's guardian?
I recently fell off wagon after being free of drugs and alcohol for 3+ years. We have been married for 16 years and seperated one other time for about 8 months. I struggled with drug and alcohol addiction but have been an involved parent since children were born. I am now sober and expect full custody of my children. But my wife is bitter and angry and claims that I am unfit to be a parent. She has changed her life insurance policy to where her sister is now the beneficiary and implied that her sister will become childrens legal guardian. The money is of no concern to me. What is of concern is that she is claiming that I would not be childrens guardian. Our boys are 13 and 12.
A: There would appear to be a future guardianship petition by maternal aunt in the offing upon the mother's unavailability to care for the children and the Court will determine what is in the children's best interests under the circumstances. Do you have any custody and visitation orders in place now?
