Houston, TX asked in Communications Law for Texas

Q: How do I fight a fake police report about me? It was for telephone harassment, which did not occur.

On April fool my friends and I called an ex-friend as a prank call. We were going to jokingly apologize for why our friendship ended and say happy Easter. The ex-friend never picked up the phone so we left a voicemail. Later that day, the ex-friend called back, we used an outsiders phone since the ex-friend blocked all of us, and when they picked up the outsider said they were a friend of ours and told her the same thing we left on the voice mail. Now the ex-friend filed and police report against some of us. It was a prank call and no threats were made.

A: If the allegations filed against you are not true. retain a local attorney, enter a plea of not guilty to the charges and force the State to prove those allegations beyond a reasonable doubt. You have the right to present whatever evidence you have to a jury, and let them decide who is telling the truth. Good luck.

A: Harassment can be committed by multiple means, not just threats. One way to commit Harassment is multiple communications that harass, annoy, alarm, abuse, torment, embarrass, or offend the recipient.
