Q: My story is long my wife is an attorney she went and got sole legal custody of our child and moved over seas.

I haven't seen my child in 10 years and child support keeps going up. She has remarried and my child is now 20 but wants nothing to do me or her sisters by my previous wife. She has even changed her last name. Why should I have to be forced to continue to pay child support until she's 23. This is wrong these laws should change. I've never been to jail I'm a good citizen Honorable discharge from the army no drugs every no domestic issues. My wife is a devil I'm just barely living paying almost $1000.00 a month and I also have a younger son I pay 300 for not her son. Can someone please help me.

A: You need to retain an experienced matrimonial attorney to bring a Motion before the Court based on changed circumstances. But visitation and child support are two mutually exclusive subjects. Pick the best lawyer you can find and remember one rule: a good lawyer is generally never cheap, and a cheap lawyer is generally never good so don't choose based on price.

The standard used to determine whether a modification of child support is warranted is whether there has been a substantial change in circumstances. The fact that the you had another son may be a reason to recalculate child support. Also, it appears that it may be awhile since child support was first calculated in your case.
