Saint Cloud, FL asked in Family Law and Child Support for Florida

Q: Can I still be charged with child support even after i have given up my parental rights?

Also can i be charged with child support if neither parent had custody of the child? Our child was taken away from both of us and placed in the care of the mothers sister. Amy the caregiver to our child happily took responsibility for her and did not ask for any financial support from us or the state. Also she has already adopted our child and yet were being sued by the state on Amy's behalf for unpaid child support and their still charging us for child support each month even when we no longer have any parental rights. How can the state be filing a lawsuit on behalf of Amy when she hasn't even asked for any child support or asked them to sue us either?

Is their anything we can do to have the child support removed and the lawsuit dropped?

A: You still owe child support which accrued until the child is adopted. The state can sue you for what it paid out for the support of the child, even if the caregiver has not asked for that.
