Q: The couple has been separated for 13 years and father was unable to find her or see the kids. He was served CS papers in
2016 and was ordered to pay back support plus interest for those years. Will he have to pay the back support even if he was unable to see or have contact with his children? (in Mississippi)
***There was no previous orders for support for the children. There was nothing in place until 2016 when he was served papers stating that he owed current as well as back child support on the children.
A: It depends. Was there an initial order in place establishing child support for the minor children? If so, then each time that a child support became due, it vested, such that he will likely be unable to discharge it.
