Q: Can my boyfriend put himself on child support in NJ
My boyfriend and his exwife divorced in PR and she lives there with their 3 kids. They signed an agreement that he will send $200 a week and he has. She has full custody of the kids, one is sick and he sends money for appointments but she will not send proof of the appointments or receipts. What can he do? On top of the 200 hes obligated to send he sends them more with no problem and buys their school clothes yet constantly threatens to take him to child support. Can he do it himself from NJ
A:
Thank you for your question.
Yes, your boyfriend may file an application to have the Court calculate child support, which can be more or less than what he is currently paying. In New Jersey, the child support amount is based upon a formula known as the Child Support Guidelines. When calculating a child support amount, the guidelines take into consideration your incomes, overnight visitations, health care premium payments and more. I suggest that you meet with an experienced family law attorney who can help you decide whether filing an application with the Court will help to protect your rights.
