Q: Title 39:3-61a explains the nessesary working lights that need to be on the vehicle in nj but is a 3rd light light neces

I was pulled over for a broken tail light and being on my phone. I asked officer to articulate how he seen me on my phone, he could not articulate how I was on my phone and went to say my tail light was out. Had both tail lights and brake lights working just my third light above my 2001 crown Victorian trunk was half working. Is the third tail light necessary if I have 2 already fully functional tail lights working? I was arrested for cds as well as the tail light. If a 3rd tail light is not needed I will fight it, if not needed would plea

A: I will leave you with this thought if you don't pay the ticket and fight it, the cop can always still file a ticket for the cell phone generally within 30 days and then you have to fight both tickets. If it was me I would just pay it and fix the light.

A: I wouldn't fight a tail light ticket but if you have to then file a motion to suppress the stop.
