Sacramento, CA asked in Domestic Violence for California

Q: Can I still file a report for domestic violence that happened in 2010 CA?

Threatened To kill me if I went to police, sexual/mental/verbal abuse as well as tried choking me to death, threats to kill me and loved ones, forced to witness acts of violence, and 8 months worth more. Including him and his sister and friends telling me to kill myself. Family had to literally rescue me.

A: If this incident occurred in 2010 and there have been no other more recent incidents, it's highly unlikely the filing a DV report would result in any legal action. The statute of limitations has long passed for the majority of potential charges, with maybe the exception of some sexual related charges, but that would depend on the specific details. Suggest you make a trip down to your local police/sheriff station and provide them with the information on the incident(s). They will advise.

A: i do not think they will accept a late report of 7 years............however this sounds more serious than most and they may investigate and find something more recent where the statute of limitations has not run.
