Q: I want to take custody of my nephews biological sibling from the state. Is there president for this in KY?
My brothers ex had baby #4 about 6 months ago and he is in the custody of cps. They are giving me the run around because im not blood or currently related by marriage or adoption but my brother and his wife have full custody of his and the exs son and the wife adopted him. The oldest son is in the exs "dads" custody who him and his wife had custody of her as a child. the other son is with her "dads" sister in law. All good people but older and cant take another child. My wife and i have 2 kids from her previous marriage and have wanted to adopt. We are a same sex couple. The 2 older boys want to know the baby like they do each other and we want to help. The other available family may say they would but due to past actions we know they would not let the kids know each other or work with other family members.
A: You could file a motion in the CPS case to possibly be awarded temporary custody by the court. Since you have never had possession or provided for this child, you do not have standing to file for custody as a “de facto” custodian. Your only shot is with the court in the dependency action.
