Q: I have joint custody with my ex who is posting videos of my kids on his social media for commercial gain. Can i stop him
I have joint legal custody and I am the residential parent. My ex is a deadbeat - no job, no money. Now he is posting outrageous videos of himself and my two kids ( ages 7 and 8) where he is misbehaving in stores, trespassing on pvt property, etc. He is posting these videos on his profile to get more likes and followers and make money. He currently has 60,000 followers. I don't care what he does with himself but I don't want my kids to be a part of these videos. Can he post videos of the kids for commercial gain without my consent.
A:
You need to retain an experienced matrimonial attorney who can bring an appropriate motion before the Court to solve both of your problems with your ex-husband. He is endangering the welfare of the children by what he is doing.
Under New Jersey state law, it is assumed that regular contact with both parents is in the best interests of the child, though certain circumstances can change that. However, there are other factors that go into determining a child’s best interests and which custody arrangement can best serve those interests.
These factors include:
Your child’s relationship with each parent
The parents’ willingness and ability to communicate with each other
Stability of both parents
Any history of domestic violence
The child’s preference
Practical considerations (such as distance between the homes, distance between the homes and the child’s school and related issues)
This is obviously not an exhaustive list. Child custody statutes are complicated.
Pick the best lawyer you can find and remember one rule: a good lawyer is generally never cheap, and a cheap lawyer is generally never good so don't choose based on price.
