A: This is a tough situation and something that you will have to have to hash out with your lawyer prior to holding a suppression hearing in your case. That being said you have two potential winning arguments.

Again though, I stress this is the sort of case where your attorney must put this on and make a motion for a suppression hearing. A key point is whether or not you got issued a ticket for running the stop sign. Did you? If you did not then I could suppress everything that happened afterwords as fruit of the poisonous tree. If they did write you a ticket we would have to argue that the police lotta lacked probable cause to search the vehicle without a warrant. So you have two potential winning arguments to suppress everything they found, giving the DA no choice but to dismiss the case as all the evidence is out.

This becomes a very difficult case unless you prevail at your pre-trial suppression hearing. I routinely do these hearings so if you would like to speak to me free of charge via phone you may call me at 914-912-1555. Aubrey C. Galloway III, Esq.
