Q: im seeking zoning approval for a home based federal firearms license and the zoning department refuses to contact me

i live in a general residential zoning district witch allows home based business however mine is being denied without any explanation where do i go from here

A: Zoning is very specific as to the political subdivision that has jurisdiction over the real property. You will then need to find the zoning ordinance for the real property. The ordinance will give you specific guidelines as to the procedure. I believe that you are seeking a "use variance". In most political subdivisions the application is made to the zoning inspector. His decision is then appealed or forwarded to the planning commission and then onto the Board of Zoning Appeals. (The names change based upon the zoning ordinance.)

If you have followed all of those procedures and have exhausted all of your administrative remedies, then you may appeal the matter to the Court of Common Pleas.
