Massapequa, NY asked in Business Formation for New York

Q: Can my families 40 yr DBA be signed over to me even though I would be changing type of business?

My family has had DBA soul prop.for 40 years. It was to be signed over to me end of June. No longer makes sense for it to stay same type of business. my mom Is emotionally unstable and liar. She is claiming she cannot sign corp over to me. She must end it. That it can't be signed over to me to be taken in new direction. Different type of business. But for reasons too long to go into I cannot trust a word she says. I have devoted/sacrificed 17 years of my life to this business. I earned right to hav ot signed to me as my gram signed to her. Earned it more then she earned it. She intends on ending it rather than signing over to me to make my own. She says legally she cant because it would have to be same exact business. Corp and owner one in the same. Nothing i have read, researched backs up that she cannot sign over corp to be taken in new direction.

A: It can be assigned to you, but there needs to be a formal assignment. You have no inherent right to it.
