Oakland, CA asked in Criminal Law for California

Q: Arrested March 29 , 2018 misdemeanor I bailed out bail was only set at 2000 I have no prior criminal history .

My court date was scheduled for May 10’th I received in the mail the latter part of April a Detention Certificate from the Sheriffs Dept , it stated that my arrest was not an arrest only a detainment and further , the District Attorney had declined to prosecute my case I notified the bail bondsman, he confirmed that I was not on the courts calender any longer, He said no arrest no prosecution this is concluded . Because of this I did not go to my scheduled court date on May 10. On May 16 I received in the mail a notice that I have awarrant for my arrest for FTA and that my bond has been forfeited . I realize that the DA has the right to file charges for up to one year but after sending me this communication prior to my initial court appearance , with the natural conclusion by me that I would not have to appear , this seems incredibly unfair And why would the prosecuting attorney not tell the judge that I was sent a detention certificate? Your comments please

A: The other attorney is correct. You can't trust other systems and would have had to confirm with the court or the DA whether you were on calendar. At this point, you need an attorney ASAP. Either call me or ask for a public defender. (714) 321-9999
