Q: H1-B change of employer on W2 and pay stub
I have been working for "company A" for past 4 years and due to some recent changes our company has decided to be part of certified professional employment organization (CPEO) which will be responsible for our benefits management, payroll processing, human resource support and compliance.
Partnering with a CPEO requires all of the employees to become co-employees of the CPEO, the CPEO name is Inspirity. Their primary focus beyond the benefits and payroll processing is to ensure that we are in compliance with HR regulations.
The point is :
Our pay stubs and W-2s will reflect "Company A and Insperity", as they are the “Employer of Record” in the eyes of the IRS.
Will this affect my H1-B?
Do I have to apply for new H1-B or any kind of amendment?
I am also planning to go for Visa stamping, will this affect stamping? Do I have to carry additional documents for stamping since my I-797 only says Company A and paycheck and W-2s will be from "Company A and Inspirity"?
A: This could definitely be an issue with your H-1B status. Schedule a consultation with an attorney experienced in employment-based immigration law.
