Q: Father have custody
He is leaving my daughter at grandmother house , she is living and staying there. She goes to his house on the weekend every two weeks. If he have custody , is it legal for my daughter to be living at the grandmother house and not his ? She says he can’t drive her to school in the morning so she stays at grandmother. Can I file for immediate custody first and then file for complaint of modification?
A: If you have an existing Judgment giving father custody you would be filing a Modification and Motion for Modification of the Judgment .
