Denver, CO asked in Animal / Dog Law and Landlord - Tenant for Colorado

Q: My landlord is threatening to “get rid” of my dog, there isn’t a no pet agreement in the apartment.

She verbally broke the lease which we have until August and gave us 48 hours to leave, because I refused to put the dog out of the apartment.

A: If the lease allows you to have a dog and she’s is now forcing you to get ride of the do without any reason (i.e., the dog is aggressive or a nuisance), then you can stay and fight the eviction proceedings (because she would have to formally evict you). She cannot enter your property and remove your dog, so do not worry about that.

A: You need a consultation with a landlord /tenant lawyer. Regardless of whether it's legal or not I've seen landlords take matters into their own hands regarding tenants' pets and just claim the pet must have ran away.
