Byhalia, MS asked in Criminal Law for Arkansas

Q: How many controlled buys would one have to make on another in order for the charges of delivery to hold up in court.

I am facing charges of one count of delivery of controlled substance not methamphetamine or cocaine as well as use of a communication device. To my knowledge, one has to make more than one controlled buy from the same persons In order for charges to be legit!? If this is, or isn't true, I do not know. This is just what I've always heard to be true. Can I get a more elaborate explanation of this, in general?

A: Delivery only requires on transaction. The weight (amount) of the substance modifies the possible penalty.

The delivery statutes are here: https://law.justia.com/codes/arkansas/2017/title-5/subtitle-6/chapter-64/subchapter-4/

There is no requirement for multiple transactions.
