Vacaville, CA asked in Criminal Law, Federal Crimes and Immigration Law for California

Q: My husband is in fed prison and has Spoken to ins already

My husband is having to do 36 months for identity theft under 10k. He has had is interview already wit ins and she told him if he hears back from them then he has a hold. The judge also told him he is approved to go to a RDAP program. Meaning his time would be way less then 36 months. He has spoken to his counselor at Taft correctional and she has told him that he has to wait for a 2nd interview. I’m not sure what I need to do to help him get into the RDAP program. He also has a permanent residence card he is from Philippines. He also has 2 children who are citizens and also married to me who is also a citizen. Please someone help.

A: much more info is needed

the best advice would be to talk to the lawyer who represented your husband in court.

s/he will have all the info on the case and not just part of the info.

a lawyer will have to spend some time evaluating and making calls and your original lawyer would have that info in the file.

good luck
