Katy, TX asked in Probate for Texas

Q: Does a letter to beneficiaries need to be sent after probate if it is intestate?

Newly appointed indep. admin with attorney new to probate has only notified me to send letters to creditors, file taxes, and record inventory. But, sites have stated that beneficiaries must also be notified. However, it always mentions because of a will. Does this also apply to intestate probate?

A: In an intestacy the heirs (beneficiaries) are notified before the hearing. They are given the opportunity to sign Distributee's Agreements and Waivers of Notice [of hearing].
