Asked in Criminal Law for California

Q: If I was arrested, along with 2 friends, for possession of paraphernalia and methamphetamine, should I plead not guilty?

Syringes were found in my car, the police believed they had heroin in them and later tested them and found the substance to be meth. I was down the street when the police approached the car, and my friends and I were not found with anything on our persons. The car had been in my ex's possession until two days before and was packed with stuff. One syringe was found on top of my purse, which was at my friend's feet on the passenger seat floor. The other syringes were all found throughout the car. No bags with drugs in them were located. No field testing was done, all testing of the substance was completed at the police station. None of us were drug tested. We were released after being booked, no bail was necessary.

A: Call an attorney ASAP. Don't talk to ANYONE and that included online (here). You're in a jam and it can get a lot worse with a misstep. You need an attorney.

A: much more info needed.

probable cause to arrest?

they are probably just charging you with constructive possession............often that is not fair.

at first blush, I was thinking of taking the approach that syringe was your wife's until you said one was on top of the purse.

do not plead to anything without a private or court-appointed lawyer. That person will have all the facts from the police report.

if you can afford a lawyer i would be happy to give you some names for that courthouse.
