Charlton, MA asked in Family Law for Massachusetts

Q: Grandparent was awarded Grandparent Visitation. Grandparent no longer takes court ordered visits.

How do I ask the court/judge to modify the JUDGEMENT for Grandparents Visits to state "Visits will be at the sole discretion of the Legal Guardian or void the JUDGEMENT?

A: In order to change the Judgment you must file a modification of judgment. At court you will have to first convince the judge there has been a change in circumstances since the Judgment was issued. I would assume, based on what you have said, that the change is that the grandmother does not exercise the visitation. If the judge agrees that there has been a change in circumstances the judge will then hear your complaint at which time you can suggest how the order should be changed. Good luck
