Q: Weinberg & Assoc. levied our bank acct. They represent Ally Bank for auto loan repo 2016. Never served. Legal?

A: Generally no. You need to get a copy of whatever order the bank was served with. Chances are there is a court that they went to to get a default notice. You need to get those records as well. Only then can an attorney help you unravel this. If you get ALL the documents, then contact a consumer attorney. But they need to know the court docket, filings etc.

Early in the filings should be a sheriffs return of service (unless Philadelphia). That would say how it was supposedly served on you.
