San Jose, CA asked in Gov & Administrative Law, Criminal Law and Constitutional Law for California

Q: Do I need a new attorney for a new trial in another state?

My daughter was arrested for trespassing and disorderly conduct. My daughter was attending private school at a town in Oregon we used to live in. She was visiting an old friend's home where the mother married a new man and then he had her arrested.

The judge declared a mistrial due to police misconduct where the police made up false bad character evidence against my daughter and one of her witnesses, Oregon is now barred from further prosecution. The prosecutors is trying to get a new trial in another state. They don't want it in Washington because it likely to be in Seattle, our hometown and it was the Seattle police and DA's office help exposed the police misconduct so they don't trust them.

Most likely it would be in California, it is in CA would my daughter would need a new attorney licensed in CA? Her current attorney is trying to get the case dismissed. She was able to get her current attorney for free since he is her boyfriend's father.
