Q: I adopted my soon to be ex wifes daughter. She uses her against me and I am at no end. Is there a way to unadopt?

I adopted her 5 1/2 yrs ago. I am at the point where I am looking out for the best interest of her. I love her more than anything, but her mother uses visitation against me whenever I dont do exactly what she wants. I dont think it is best for my daughter to see me when it is convenient for her mother and then when she comes and sees me I have to try and avoid the question as why I haven't gotten her on the other days that I am supposed to have her. I am trying to figure out what is best for her.

A: Looks like there is no court order.

When you get divorced, there will be a parenting plan.

After the parenting plan is entered, you can force her to comply with it through contempt proceedings.

A: Have you considered fighting for the majority of parenting time (once referred to as custody)? When you adopted her you became her parent in every respect that her mother is, and you have an equal right to fight for the majority of the parenting time. It is unusual for the adoptive parent to become the primary custodian, but it has happened. Whether you are a biological parent or an adoptive parent or not, your rights under the parenting plan are your rights, not her option to grant or not; it is a court order, not a court suggestion.
