Q: Do we have to refund the money back to the hotel?
My mom owns a legit cleaning business she has everything you need permits etc. Anyways a hotel called her they needed maids for 4 days last minute they verbally agreed to about 2,450. So the first day the cleaners showed up,they were trained then told to go clean. Long story short the hotel employees were very very rude to her staff like they are below them, and rushing them eventually telling them to leave for the day. After this happens the staff calls my mom tells her what happend about the hotel employees being rude and kicking them out basicaly. So my mom calls the manager she got the payment from and the manager is asking for a refund for the remainder of 3 days. But my mom already payed her employees and used for other bills. Most importantly there was no contract just verbal agreement for 2,450 for 4 days of cleaning. Does she have to refund the money even though the hotel does not want to continue with us. Thanks
A: Without a written contract, there may be a problem. Technically, once your mother's staff were kicked out with 3 days remaining on the verbal contract, the Hotel may deem the contract over. However, since the contract was verbal, it is like no contract was made. I would suggest that your mother call the Hotel and offer to refund one day of fees paid, and see if the Hotel will agree. If an agreement can't be made, then the Hotel may want to file suit, or a small claims action. At that point, your mother could agree to refund two days worth of fees. The important thing to take away from this is that your mother should never send her staff anywhere without there first being a signed written contract between the parties. It does not have to be too long and technical, but it must specify the work to be performed, the date the work is to start and to be completed, and how your mother will be paid for the work.
