Covina, CA asked in Domestic Violence for California

Q: I wont testify against my fiance for a domestic violence but they still want him to go to court, what is going to happe

I called the police on my childrens father for hitting me twice. The first time he went to jail for 2 Days then they released him and said they didn't pick up the case. The 2nd time he left before the cops came and they took a report. Then they asked if I want to press charges and I said no. This incident was in march of 2018 now the D.A is barley calling me asking if I want to move forward and what I want to see happen and I told her nothing because he is a good father and he has a good job and never had anything on his record. I was mad about infidelity so I exaggerated harm done to me and I deeply regret it. She said that there still is going to be a court date and I'm just scared of what is going to happen to him. He wants to get a lawyer but I'm not sure it is necessary yet. He helps a lot with his daughter and if he goes to jail its going to affect us all financially & emotionally as we have another child on the way and he won't be here to work let alone keep his job

A: NEED MORE INFO

BOTH OF YOU SHOULD CONSULT WITH SEPARATE LAWYERS.

THE CRIME IS AGAINST THE PEOPLE OF THE STATE OF CALIF AND YOU ARE A WIT/VICTIM TO THE CRIME. IT IS NOT UP TO YOU TO DROP...AS A RULE.

YOUR LAWYER SHOULD TALK TO THE DA NOT YOU.

YOU WILL SAY SOMETHING THAT WILL HURT BOTH YOUR CASES.

YOU ARGUABLY GAVE FALSE INFO TO A POLICE OFFICER.

THEY ARE USE TO VICTIMS NOT WANTING TO PURSUE A MATTER B/C THE BREAD WINNER WILL BE IN CUSTODY AND NOT WORKING ETC

IF YOU NEED NAMES OF LAWYERS CALL AND I WILL TRY TO GET YOU NAMES OF GOOD LAWYERS FOR THE COURT YOU WOULD GO TO.
