Rialto, CA asked in Real Estate Law for California

Q: What can I do if I do not have money to hire a real estate attorney?

I bought a house in February 2016, in March of this year my monthly payments increased because in my property taxes are charging a HERO program lien that the previous owner had, during the process of the transaction nobody said something about this lien against the property. I did not sign any document accepting the payment of this lien. If this payment it would had included I wouldn't be approved for the loan. In the preliminary report was mention as exhibit A and B, because are two HERO liens, but it is not clear. . I went to obtain a copy of the recorded lien and reading the document I have to pay for 16 years $1,539.13 two times a year and for the second one $1,101.79 two times a year for 7 years, a total of $5,281.84 a year, at the end of the years the amount is about $40,750, this is unacceptable. That means the price of the house was more than $300,000, with my income impossible to pay it.

Thank you for your help.

A: I have some familiarity with HERO program. Their lien is secure against your real estate and the escrow company should have paid them off from the selling price, or you did actually assume it. please review your offer and ask your real estate agent about it.
