Q: Wanting know if this class b misdemeanor can be dropped
Yes I go in trouble at Walmart for shoplifting I've never been in trouble with the law ever it was exactly $150 I got arrested and bonded out next morning. It's a class b misdemeanor. And Walmart didn't give me a criminal trespassing or band me. And Walmart didn't lose anything they got everything back. And I hired one of the best lawyers he not even in the same county as I am he charged me $1800 and only reason why I hired him is because I was told he could get me off on it. And I've been to court 3 times already and I'm not happy with the deal their trying to get me. And my lawyer is not doing what I know he can do. So I'm wanting to know from another lawyer point of view what their perspective is. I don't want probation I don't care if its on my record or not on my record that not an issue. So can u give me what ur thoughts are about it. Can't they just give me a huge fine and I pay that at once.
A: No one in this forum knows the particular facts of your case, and the evidence the State has in its possession, so no one can tell you what options you have. Understand, however, that just because you do not like what your attorney is telling you does not mean she/he is not doing her/his job. Have a sit down with your lawyer. Good luck.
A: First, a lawyer cannot give you "thoughts about " your case without the facts. Can the charge be made? Was the arrest legal? Assuming charges can be made and the arrest is legal, and you're are convinced you can be convicted, and legally, the only way I can tell you about the offer that is being made is to know the offer. What's to dispute? Class B misdemeanor punishment is up to six months in jail and a fine. First offender, you should not be looking at jail time. Can they just give you a huge fine? Sure. Are they willing to offer that is the question, and since you are asking, I'm guessing they are not willing to offer fine only. Hold out for what you want in the way of disposition, and do not plead guilty to probation. Patience in this system is a virtue. Use yours Be patient. Your lawyer can handle the rest.
