Q: Hubby is responsible for work related daycare , but the custodial parent hasn’t given any bills etc for him to pay.
now she has given 3 years worth of expenses (no bills) for the total of 11,000 and expects him to pay.....does anyone know if there is a time limit required to give him a bill and not a total to pay? Also, she works only 2 days during the week but has the child attending all week.....his order says he is to pay 64% of work related child care which represents his proportional obligation pursuant to the Rule 32 of the Alabama Rules of Judicial Administration, but it is not to exceed the cap imposed by the Baldwin County Department of Human Resources. Does that mean he is responsible for an entire week or just the days she is going? should we require bills from the daycare? He has also asked her 3 times for the kid,has given the 48 hour notice & she denied each time. can he do anything w/modifying the order for visitation & claiming on taxes? He would like to get visitation set in a certain manner to where she can’t dictate when she can and can’t meet him.
A: Big welter of facts here. Has he been sued for his failure to pay the day care? Day care must be work related before he has to pay it. He is only responsible for the actual cost of care -- up to the cap -- for day care that is necessary so she can work. The order should have set out how this payment is going to be proved up or what the system for knowing what the cost of the invoice actually is. Visitation should be set out specifically in the order. The custodial party gets to claim the child on taxes without an order saying otherwise. I am in Baldwin County
