Q: Waiting time for a work permit after marriage with a naturalized citizen. Should I expect any problems with green card?
I'm currently in the US on a tourist visa and I have already filed for the extension (six months of my stay has just passed). My fiancee is a green card holder and soon to be a citizen. I would like to ask whether I can experience any problems with my future green card process since she's not an US born citizen (she has received her green card through marriage). Also, how soon (after marriage) can I expect to get a work permit? Perhaps it would be easier / safer to go back to our home country (Poland) and start the whole process from there? I would also like to add that neither of us has any prior criminal record.
A:
There is not difference between a native-born citizen and a naturalized one when it comes to immigrating through a citizen family member.
Typically it takes between 4 and 5 months after the green card application has been filed before an applicant receives a green card.
Once your fiancée is a citizen, she can file a visa petition for you at the same time you file an immigrant visa application in the US.
