Q: Hi..my dad passed 3 weeks ago he has a large estate but im the only child no wife will i have a hard time in probate?
I filled out all the forms and they gave me a court date to see a judge. He also owned houses and bank accounts. How long would it take to get his things
A:
You won’t mecessarily have a hard time in probate court, but there are procedures that need to be followed. You will not be able to close the estate until after the 4-month creditor claims period has closed. So plan on having the estate open at least 4 months after notice to creditors goes out.
Many people find it helpful to hire an attorney to help them with administration, which can help to avoid delays. If you are unsure why the judge has scheduled a hearing, an attorney can help clarify where you are in the process, and possibly help you take care of whatever needs to be done without a hearing.
