Q: I work for a NJ-based company and had a baby last year. I'm pregnant again and worried I will get fired when I tell them
I work for a NJ-based company. They are a small company with only about 10 or so employees, so I’m not sure what my rights are, if any.
I had a baby last year. I found out after returning to work that I would then be eligible to receive 6 additional weeks of partially paid bonding leave through the state before my baby turned one.
During my leave, he sent me an email saying that since they were a small company, they didn’t have to grant me any of the leave but did so anyway. He also said I won’t be eligible for any additional medical leave until one year after my bonding leave ended, or in other words, August 2019. Basically, without officially saying it, they are saying I will lose my job if I have another baby before August 2019.
A month later I found out I was pregnant and will be due in March. I can only assume I will be losing my job as a result because I will need to take maternity leave. I’m guessing this is perfectly legal because they are a small company.
A: Discrimination based on pregnancy is still illegal under the NJLAD, regardless if the employer is a small employer. If you feel you are being mistreated, discriminated, or fear you will lose your position because you are pregnant, consider a consultation for a case evaluation.
