Fort Lauderdale, FL asked in Contracts and Real Estate Law for Florida

Q: Am I under contract? 2nd question

I received a signed contract from buyer´s realtor, then I made changes in two clauses, initialized those 2 changes AND SIGNED ALL CONTRACT´S PAGES (yes, mistake). Buyer´s realtor did not accept those 2 changes and requested to go back to original conditions. Today I received better offers and informed buyer´s realtor that I need to pause and make a decision. She got upset, said we were under contract, that I already signed everything yesterday, kept texting, calling, etc. I did not answer anything and this afternoon she sent back the contract initialized on both clauses, BUT CHANGED ONE OF THEM.

She texted and emailed as if contract was already executed.

Already received an answer from a lawyer here (thank you) suggesting that I should withdraw my unaccepted counter offer.

How do I do it?. Should I sent her back last contract with "Seller rejects contract" marked?

A: You should call and hire a lawyer ASPA today to reply to buyer agent. This is not a DIY job and why buyers and sellers get into so much trouble in FL. Unlike other states FL for some reason does not require lawyers to be involved in the purchase/sale of real property. The cost will help you avoid any possible legal issues like this until closing (which will include the attorney reviewing all docs to make sure your rights are protected) that could cost many times the money to litigate.
