Cleveland, OH asked in Civil Litigation, Elder Law and Medical Malpractice for Ohio

Q: Mom 66 years old, owned LLC, was president- being sued, thinks assets hidden? How can they sue her?

This has been going on for 5 years.. If it is an LLC and she was President ..there was no piercing of the veil.. how can they request a debtors exam?? she is on SSI, home was foreclosed on, she rents an apartment, it was a bar , there were no assets .. She is basically bed ridden, heart attack when she was 52, numerous surgeries, most recent cancer.. court is Thursday and she will not go with us.. what is the judge going to do ? I know you are just speculating.. but I can go in greater detail why this has been dragged out.. I also need a Medical Malpractice Attorney - she has a mesh implant her doctor said the company needs to be sued... but this case is Civil Litigation ( & we need an attorney who handles Negligence because we had a judgement against the person sueing her & he never followed through on it & it came to this.... very sad situation...

A: On the mesh implant if the implant was less than two years ago I can get you the name of an attorney who will give a free consult.

On the michigas with the bar, seems that she should contact a bankruptcy attorney. If she's judgment proof no downside; it stops that other litigation.

A: Another thought--the bar, if it had insurance, that should be covering her, giving her an attorney. If not, worth getting a bankruptcy consult. If she can't afford it probably worth the relief from agina for her kids to chip in.
