Q: I am named executor and sole heir of my late father's estate. He left an auto, titled in Iowa in his name only.
However, the Oklahoma Tax Commission insists they will not transfer the title to an Oklahoma title, and put it in my name, because it is an out of state title, unless I produce a document signed by a judge confirming that I am my late father's personal representative. I have Dad's will. He has an estate worth less than $20,000, &15,000 of which is what is owed on the car, with a lien from a finance company. The finance company approved me to assume the loan, but Oklahoma won't title or register it, so I am stuck paying for a car and insurance that I cannot drive. I see no need for probate, as he has no real estate or assets. I am an Oklahoma resident. Is my ONLY option to hire a lawyer and to go thru probate, or???
If the title was from Oklahoma, I could simply sign an affidavit and the car would be titled and registered in my name.
