Q: Can I still get child support court ordered even though I'm currently not working? I'm the primary custodial parent.

I moved to Alabama right before my ex husband got out if the military and he then moved to Idaho. He rarely ever sees our daughter. He is getting laxed on paying child support when ever he feels like it. I'm currently not working due to me pregnant. I'm engaged and have my daughter and step son who I care for.

A: You question is not clear. Are you divorced from him? THen he has to pay according to the order. Did you not divorce him? I assume you are divorced because you are engaged. He has to pay according to the order that is now in place and ever month he does not pay is counted as a final judgment (under Alabama law). Provide some detail and maybe someone can answer your question. Your working or not working has nothing to do with it unless you go back to Court. He can't decide when to pay and when not to.
