Q: can I file forgery charges against my personal injury atty ?

my atty or someone in his office signed the final release in my personal injury case. I wanted to take my case to trial. I have been severely damaged and my case was a big one against big companies, AT&T, Time Warner, Southern Cal Edison, Pac Bell, Verizon, the City of Stanton, Spectrum . I have TBI from my accident , 8 facial fractures, loss of memory, severe headaches, weight loss and so on . Please direct me to someone that can help me. Thank you

A: Some attorneys have their clients sign an authorization to endorse the settlement check. You should have been notified about the settlement numbers and then agreed to take the settlement amount. You should look through all the documents you signed and if you still think something was done without your authority then you should seek a consultation with an attorney right away.

A: Your Retainer Agreement may have included a Power of Attorney allowing your lawyer to sign the Release for you, if you consented to the settlement.

It is unclear if you consented and have changed your mind, or if you never consented at all.

If you want to pursue your attorneys, you can file a complaint with the State Bar here: http://www.calbar.ca.gov/Portals/0/documents/forms/2017_ComplaintFormENG_201701.pdf

You should also consult with some legal malpractice attorneys. I would suggest asking your attorneys for a copy of your file so that a legal malpractice attorney can review it.
