Modesto, CA asked in Family Law and Child Custody for California

Q: What CA family law code states a non-custodial parent may designate another adult to transport minor for visitation?

The current order does NOT specify that the parent must personally pick up/drop off minor. Stanislaus Co order, child resides in Santa Clara Co, non custodial parent resides in NV. Has never been an issue in 5 yrs, but custodial parent states refusal to release minor to anyone but biological parent even though minor has previously been released to grandparents, without incident or concern, primarily for 5 yrs.

A: I am not aware of any such statute without doing the research. Courts generally do not restrick pick-ups and drop-offs to the legal parent unless someone asks for that order and there is a history of bad blood between one of the parents and the non-parent. If the restriction you mentioned is not in the court record, that would also support my feelings.
