Elmhurst, NY asked in Traffic Tickets for New York

Q: Received a 1225-c (2) (d) ticket in NYC instead of a regular cell phone ticket. I’m not a commercial driver or car.

I received a traffic ticket in New York City. The ticket states the violation as “Motor carrier allow/require driver to use cellphone in cmv.” My car is not a commercial vehicle and I am not a commercial driver. My question is will the judge at the DMV throw it out right away, or will he be able to amend the charges to a regular cell phone ticket that comes with points and the fine?

A: You are lucky, because it records as a 0 point violation on your driving record. If you fight it, they can change it to the correct 5 point charge in court.
