Q: Who will be deemed responsible in the accident?

I was at a stop sign at a T intersection. I was going to be making a left hand turn. I checked both ways to make sure I was clear and there was a car 250 ft back. The guy sped up as I was in the intersection. He was doing about 50 mph in a 35 zone. He was looking down and approached me. I layed on my horn. He swerved into me and hit my from driver side. My passenger and driver airbags deployed. The man refused medical treatment but my mom and I received medical treatment. Who would be deemed responsible? I checked and knew I was clear, but he was distracted and sped up then swerved into me. He bent my tire off the axle and smashed my driver side front end.

A: On your facts, you had a stop sign. The other driver had the Right of Way. You were obligated to Yield the Right of Way. The moment you decided to enter the intersection, you were primarily responsible for the accident.
