Lubbock, TX asked in Car Accidents and Small Claims for Texas

Q: Need help with a hit and run case but with no personal injury just total loss of my vehicle.

I was the victim of a hit and run which resulted in my only vehicle being flipped and totaled but there was no major personal injury so Ive been unable to find a lawyer to help me get compensation outside the car insurance company. The person was found and yes we are currently working with their insurance for a payout of the vehicle, however, this has been a massive disaster to my life and the car meant a great deal to me as my now deceased father gave it to me. It has upended my life and made it very difficult and the stress, pain, and suffering has been monumental. The person who hit us has shown no remorse or care for what she did given the severity of the accident and attempted to run and not own up for anything she did. She endangered my life and the life of the passenger she was carrying at the time. She even lied to her insurance, not telling them she fled the scene. I feel I deserve more than just the vehicles blue book value and she deserves more than a citation.

A: Based on the severity of the accident it is highly unusual for their not to be any injuries sustained. So, therefore you are highly blessed. But, sometimes a lot of folks don't feel the pains and discomforts right away immediately after an accident and I would suggest that you get checked out and wait to assert the position that you and not injured. Unfortunately, you are left in a mess due to someone else's negligence. We believe that people should take personal responsibility for their actions. Good luck in your matter.

A: I'm glad there were no major personal injuries. Despite the aggravation that such an accident can create, insurance carriers provide remedies that fall into more or less standardized categories, such as property damages, medical expenses, lost wages, pain and suffering, etc. If you do not agree with the carrier's determination of the property loss figure, or wish to discuss other forms of damages you feel may have arisen here, you could contact an attorney in Texas.
