Q: What is the process with an inmate who is in County Jail who has a Immigration Hold?
Lets say a inmate in County Jail has a immigration hold (detainer) placed what is the process?
I know it was that ICE had 48 hours to get the inmate in their custody or if not county releases them. But now is it the same or does county have to hold them until ICE picks them up(no more 48 hours)? Since Texas has SB4 in effect (Hidalgo County)
A: The law enforcement agency is only supposed to hold the inmate up to 48 hours, not including evenings and weekends. If ICE does not come, the inmate should be freed, as long as s/he has fulfilled all legal obligations with the law enforcement agency.
