Englishtown, NJ asked in Family Law and Child Support for New Jersey

Q: Is a divorced Dad obligated by law to help pay his sons car payment and insurance?

My 16 year old step son will be getting a car soon. The car and insurance is going under my stepsons Moms name. My Husband already pays her child support and alimony. We just looked through his whole divorce decree and it states nothing about having to help pay for a car, only about of course helping to pay for college after the child has exhausted all loans, financial aid, etc. My Husbands ex wife is asking my Husband to pay half of the car lease payment as well as half of the insurance. Are we right in saying that it is on her?? Thanks so much.

A: Thank you for your question.

The short answer is possibly. It really depends on what the parties agreed upon in their Marital Settlement Agreement. While child support does include transportation costs, it does not include expenses associated with a motor vehicle purchased or leased for the intended primary use of a child subject to the support order.

I understand that you need answers and need to protect your family. I strongly suggest that your Husband schedule a consultation with a family law attorney who has experience with Child Support as soon as possible, so that you can understand the implications for you.

A: That will depend on many factors, which requires an in person consultation and document review by an experienced matrimonial attorney. To properly answer your questions and address your concerns, the best way to handle this is by retaining an experienced matrimonial attorney. You need the best attorney you can afford, do not let geographic considerations be a factor in your choice of an attorney. Pick the best lawyer you can find and remember one rule: a good lawyer is generally never cheap, and a cheap lawyer is generally never good so don't choose based on price.
