Minneapolis, MN asked in Criminal Law for Minnesota

Q: So my boyfriend is in jail, he went to court and was released w/o having to pay. It was put in the system incorrectly

Saying that he has to pay to get out instead of being released on his own so he can go to the next county.. he has tried calling the court office and they said he has to wait until March to see the judge again. He asked a bondsman to just bail out and it says that he doesn't have bail so he cant bail out. So who do I need to contact about getting the information in the computer fixed to state that hes released like the judge ordered?

A: There should be a written release order signed by the judge. You need to get a hold of that because that will indicate what the Court actually ordered.

A: In that situation, the presiding judge that day would be in the best position to fix the error. To accomplish that I would call the judge's office and be prepared to speak with the judge's law clerk about it. Then follow their lead. Of course, a lawyer could help but you could try it on your own. Of course, get a copy of the written Order setting term of pretrial release first, to compare with what was entered into MNCIS and the court's Register of Actions. Court Administration should be able to help you with that part.
