Q: Need help to decide notice to Quit deadline

In a nutshell, tenant had written month to month lease signed less than 6 months ago, but lived there for 17 month on verbal lease. Tenant ended their written lease agreement with a 30 day notice on the 1st of month. I acknowledged the lease ending and noted that I expect tenant to move out at the end of the month. Tenant did not pay me for that month and did not move out. I posted late rent notice 10 days after rent was late. Negotiations began for tenant to get new lease. Negotiation failed, too many strings attached, too many demands and to many games. Still no rent, now 60 days behind, 30 of that on squatting time. It’s middle of winter. Do I need to give a 30 days notice to end agreement (she technically already ended it, so do I need to end it too?) and then another 10 day notice to quit or can I give the 10 days notice to quit due to late rent now and file eviction papers at the end of 10 days?

A: You gave him the 30 days. File at the magistrate then give him the 10 day notice the day before you file.
