Q: We are selling our house and closing date is written on the contract as, "on or about 12/20/2018.
The contract also says title will transfer on 12/21/2018. Two days before closing our realator says the buyers have some things to clear up with their lender and can't close, but they won't give us any details. Our agent says the wording on or about is vague and we have to wait but no one will tell us how long we Have to wait. They signed the purchase agreement 46 days ago. They have come back 3 times with changes and financial concessions they wanted and we gave in at our agents urging. We do not want to agree to an extension because we believe they will do this again right before closing. The whole time the house has been off the market under active contract. We are paying their closing, down payment, paying to have central air installed and they request the electrical panel to be upgraded to higher amps. We agreed to all because our agent kept pushing us to even though we told her over and over again we did not want to. Now after all this they want an extension.
A: Prepare a contract extension with a firm closing date, with a provision that the contract can be terminated at seller's discretion if the closing does not occur on or before that date. Use the Find a Lawyer tab to retain a local real estate attorney to assist you. Agents are not attorneys.
