San Jose, CA asked in Immigration Law for California

Q: My parents received an Parole document (512L) with an error. Can they travel to home country with this document

I applied I-130 for my parents and that has been approved.

I applied for I-131 and I-485 (but did not apply for I-765). The 485 is pending but I-131 was approved.

The Advanced Parole was approved in November and the document I-512L contains the following:

"PAROLE: The named bearer of this authorization is an applicant for asylum. The bearer departed the United States temporarily and intends to return to the United States to resume processing of the asylum application."

The applicant for asylum seems to be in error. My parents applied for I-485 and the reason was Family based (Immediate relative of a U.S. citizen, Form I-130).

My questions

1) Is it advisable to travel with this document. The document says asylum but they have not applied for asylum.

2) Should i send the original I-512L document and ask UCSIS to correct it

A: First, did your parents wait until approval of the I-512L before traveling? If they did not, then they may have automatically terminated their I-485 applications.

Assuming they did wait, have they left already? If not, then call USCIS on its 800 customer service number and explain the situation.

If your parents have left already, then have them present their I-485 and I-131 receipt notices, as well as passport and I-512L, to US Customs and Border Protection (CBP) at the airport upon arriving back in the USA. It may or not cause a delay in processing, but they should be allowed in. USCIS database will show that there is no asylum application pending, and that the I-131 was issued in connection with the I-485, for each parent. (And the USCIS receipt numbers will be pretty much in sequence, another clue to guide CBP.)
